By using or accessing the Groovi Movements Exercise Software you accept our Terms of Use.

Groovi Movements Exercise Software may be used for the following purposes:

• Creating personalised exercise programs for patients using the Groovi Movements Exercise Software or Pre-set sheets.
• Sending personalised exercise programs in any of the following formats :
  – Printing
  – E-mail
  – Mobile App.
• The use of the Software requires the valid authorisation and an active subscription from Groovi Movements Exercise Software as well as compliance of the Terms of Use.

Any use outside of the above is not authorised.

Eg:      Unless specifically authorised by Groovi Movements in writing, it is not permitted to:

• Provide access to or give the Software or any part of it to any third party,
• Reproduce, duplicate, copy, deconstruct, reverse-engineer, sell, trade, or resell the Software, Protocols or pre-set sheets or any of its parts or content.
• Permit any third party to benefit from the use of or functionality of the Software via any arrangement.
• Use the Groovi Movements Exercise Software content in paper or electronic brochures, in any other software or as part of website patient education content.
• You may not save and replicate any content for future use.
• Cancelling your subscription and still using the exercises or any saved content is an offense.

Limitation of liability

Groovi Movements or suppliers accept no liability for injury, loss, cost, or damage caused to any of your clients/patients or any other person by the Software or the content or information and/or exercises obtained through the use of the Software or its content. It is your sole responsibility to ensure that advice, information, workout and/or exercises provided to your client/patient using the software and its content or the use of the software and its content in connection with the treatment of or advice to any particular client/patient or group of clients/patients in each individual case is appropriate.

Furthermore, Groovi Movements Exercise Software or suppliers will have no liability arising out of or related to the use of the Software for any loss of use, lost or inaccurate data, lost profits, failure of security mechanisms, interruption of business, costs of delay or any indirect, special, incidental, reliance, or consequential damages of any kind, even if informed of the possibility of such damages in advance.

Warranty disclaimer

Your use of the Software and its content is entirely at your own risk. The Software is provided “as is” without any guarantees, commitments, or preconditions.

Groovi Movements Exercise Software does not guarantee or offer a warranty for :

• Functions covered by the Software matching your requirements or being updated.
• The Software operating correctly or without any errors.
• The Software not damaging other software, equipment or data.
• Any software, web services (including internet) remaining available, uninterrupted and unchanged.
• The correctness, accuracy, reliability of use or other such things relating to the use of Software or the results of the use of the Software.

Intellectual property rights

Groovi Movements Exercise Software retain ownership of the Software and their content and reserve all rights.

Data Protection

Groovi Movements Exercise Software processes personal data in accordance with the applicable data protection legislation (Popia).

Term and termination

The subscription term is either one (1) month or twelve (12) months and the subscription agreement is automatically renewed for another term unless cancelled online or in writing prior to renewal.

Groovi Movements Exercise Software cannot be held responsible for failed payments due to insufficient funds or card expired. (Should this occur the new card details should be updated online for the subscription to continue)

After termination, the subscriber must delete all Groovi Movements Exercise Software related data from all computers and is not allowed to continue using any material created with or related to Groovi Movements Exercise Software.

Groovi Movements Exercise Software may terminate or suspend the service without prior notice or liability, if Groovi Movements Exercise Software becomes aware of a breach of these Terms of Use.
